“No fault” divorce
From 6 April 2022, finally the long-awaited divorce law reforms came into force in the form of the Divorce, Dissolution and Separation Act 2020. It represents the biggest reform of divorce law for 50 years and has the aim of reducing conflict between couples legally bringing a marriage or civil partnership to an end.
For the first time in England and Wales, it will be possible for couples to jointly apply for divorce or dissolution of a civil partnership. Alternatively, one party can still apply on their own.
It is no longer necessary, nor possible to divorce or dissolve a civil partnership by one party placing blame on the other. Nor is it necessary to have been separated for any particular length of time; save that neither divorce nor dissolution are possible within the first year of marriage or civil partnership, although judicial separation is. The sole ground for divorce now is a statement that the marriage has irretrievably broken down.
