Frequently asked questions

What is a lasting power of attorney?

An LPA lets someone you trust make decisions for you if you lose the ability to do so yourself. There are two types: property and financial affairs, and health and welfare.

When should I set up an LPA?

While you still have full mental capacity. You cannot make an LPA once you have lost capacity, so setting one up early protects you and your family from having to apply to the Court of Protection later.

What happens if I don't have an LPA and lose capacity?

Your family may have to apply to the Court of Protection to be appointed as a deputy, which is slower, more expensive and more restrictive than having an LPA in place.

Can I choose more than one attorney?

Yes. You can appoint several attorneys and decide whether they act together or separately, and you can name replacements. We advise on the best arrangement for you.
